By registering for the Erich Schlemper GmbH & Co KG competition (hereafter referred to as the ‘competition’ or ‘Erich Schlemper GmbH competition’), the user accepts the following terms and conditions.
These terms and conditions of use and participation govern the contractual relationship between the user and the operator of Erich Schlemper GmbH & Co KG, Bessemerstraße 42 – 44, 42551 Velbert, Germany (hereinafter referred to as ‘Erich Schlemper GmbH’).
The Erich Schlemper GmbH competition is open only to customers of Erich Schlemper who are of legal age and legally competent. The user can access, print, download and save these terms and conditions at any time via the ‘Terms and Conditions’ link on the Erich Schlemper website.
The Erich Schlemper GmbH competition offers users the opportunity to share with Erich Schlemper GmbH and the Erich Schlemper GmbH community the works they have created using products purchased from Erich Schlemper GmbH. The user has various options for designing their entry. Among other things, high-quality images with installed hose clamps can be shared.
By submitting a picture or pictures of their project with a product (clearly visible) purchased from Erich Schlemper GmbH, the customer qualifies to take part in a draw in which one customer at a time has the chance to win power banks / laptop / smartphone. The draw is at random and is carried out blind.
The Erich Schlemper GmbH Community is intended for the personal and private use of the users. By submitting an image to info@ideal-schlemper.de, the user expressly agrees to the following terms of use.
To take part in the Erich Schlemper GmbH competition, the customer or partner must submit a picture or pictures of a project that he/she has realized with a product purchased from Erich Schlemper GmbH. Participation in the competition is free of charge.
2.1 Requirements for participation
There are various ways for participants in the Erich Schlemper competition to qualify to take part in the competition.
The user can record his/her project realized with the products purchased from Erich Schlemper GmbH in the form of pictures, send them via e-mail and thus qualify for participation in the competition, provided that all conditions for participation have been met (see 2.1 d) to f)).
3.1 Conditions
Erich Schlemper GmbH reserves the right to limit or change the conditions of participation, deadlines and duration of the Erich Schlemper GmbH competition at any time, or to discontinue the competition altogether and to delete content without prior notice. The user shall have no claim to the maintenance and continuous provision of his/her project.
In particular, Erich Schlemper GmbH expressly reserves the right to restrict use, for example with regard to possible legal infringements, capacity limits, the security of the community, the integrity of the servers or to carry out technical measures in the interest of proper provision of the service. Erich Schlemper GmbH will point out any foreseeable restrictions on the usability of the competition in advance on the community platform or on the official LinkedIn account. No such notification is required in the event of possible legal infringements.
A customer is only entitled to participate in the competition if he/she has used the product that was used for the realization of the project captured in the image(s).
A customer or partner who submits a bid for a project that complies with the conditions of participation in the community competition and does not violate the terms of use has the opportunity to win powerbanks / a laptop / a smartphone. The following conditions apply in this case.
If all requirements for participation in the competition have been met and the submitted picture(s) fulfill the requirements listed in the terms of use, the customer has the opportunity to win power banks / a laptop / a smartphone.
The first competition starts on 10.02.2025. From this date, customers will have the opportunity to send in pictures. The first draw for the winner will take place on 28.02.2025 at 12:00 noon.
The competition will be repeated every three months after the first prize draw. Customers can submit pictures for the competition starting at 14:00 on the first day of a new quarter. The draw then takes place again on the first day of the next quarter at 12:00 noon.
The contract of use for the Erich Schlemper GmbH competition can be terminated with immediate effect at any time by both the user and Erich Schlemper GmbH without stating reasons and without observing deadlines.
a) Termination by the user

b) Termination by Erich Schlemper GmbH
Erich Schlemper GmbH has the right to terminate the contract of use at any time in writing or by e-mail with immediate effect. The termination shall become effective upon deletion of the user from the database.
c) Consequences of termination of the contract
After termination of the contract of use, all personal data of the user and all content published by the user shall be deleted, unless the law expressly prescribes further storage. The published content for which a prize has been paid out will be deleted under the resolutory condition that any prize paid has been refunded to Erich Schlemper GmbH.
In all other respects, the current data protection provisions for the Community apply.
The users themselves are responsible for the content they send. It is therefore the responsibility of the user to ensure that the published content is lawful, in particular that it does not violate applicable laws and does not infringe the rights of third parties.
If the user is held liable for his/her own unlawful acts or learns of unlawful acts by third parties, he/she is obliged to notify Erich Schlemper GmbH immediately. For this purpose, Erich Schlemper GmbH has provided a form in the Community which the user and other persons who are of the opinion that content published by users violates legal provisions – in particular copyrights or other property rights – can use to contact Erich Schlemper GmbH. Violations of these terms of use must be reported to the address given in the legal notice.
In addition, the user is obliged to comply with the following requirements:
a) General principles for published content
It is not permitted to send, publish or reproduce defamatory, violent, false, insulting, offensive, threatening, harassing, blasphemous, sexually oriented, obscene, racist or copyrighted, patented or trademarked material. It is also prohibited to disseminate or promote political or ideological views.
b) Publication (publication) of image files
Before publishing an image file (e.g. photographs), the user must ensure that he/she is entitled to the exclusive rights of use to the image or film file and that making it publicly accessible does not violate legal regulations, public decency and/or the rights of third parties.
In particular, the sending and publication of an image(s) with defamatory, violent, false, offensive, objectionable, threatening, harassing, blasphemous, sexually oriented, obscene, racist or copyrighted, patented or trademarked material is not permitted.
In the case of image files and film files in which other persons are recognizable in addition to the user, participation in the competition is only permitted if the user has the written consent of all persons depicted for publication on the platform. Erich Schlemper GmbH will request such consent.
It is expressly pointed out that the publication of recordings of radio programs, images and public performances or parts thereof without the express consent of the rights holder constitutes a violation of copyright and personal rights. Copyright infringements are punishable by law with a prison sentence of up to three years and a fine. Infringements can give rise to substantial claims for damages.
c) Publication of internet links
The publication of Internet links, in particular to third-party offers, with defamatory, violent, false, insulting, offensive, threatening, harassing, blasphemous, sexually oriented, obscene, racist and copyrighted, patented or trademarked material is not permitted.
The user or partner allows the group of companies to use the content sent for the provision of the services offered on the community and grants the group of companies the necessary rights of use to the published content free of charge and unlimited in terms of time and place.
By sending an image(s) to participate in the competition, the user agrees that this image(s) may be published for advertising and marketing purposes on the company’s relevant social media platforms and newsletters.
These rights of use include in particular all exploitation rights within the meaning of Section 15 UrhG, i.e. in particular the right to reproduce, distribute, exhibit and publicly reproduce the content within the meaning of Section 15 II UrhG.
The group of companies is entitled to reproduce the works on its own website, in particular in close proximity to the products offered. The group of companies shall also be entitled, but not obliged, to make the works available to third parties on social media platforms and newsletters.
Erich Schlemper GmbH allows the user to use the services offered by Erich Schlemper GmbH on the community platform for the duration of the user contract and grants the user the non-exclusive, simple and non-transferable rights of use.
7.1 Placement of advertising and promotion in the context of the competition
The group of companies is entitled to place advertising and/or carry out other promotional measures in the context of the publicly accessible content and using it. The user expressly agrees to this.
1. Release from liability by the user
The user shall indemnify the group of companies against all claims asserted by third parties against the group of companies on the basis of the published content or through the use of the service provided on the community. The indemnification is independent of whether the user has contributed the content him/herself or has used the services him/herself. In such cases, the user shall assume all costs of legal defense, including all court and attorney’s fees in the statutory amount. Further claims for damages of Erich Schlemper GmbH against the user remain unaffected.
2. Limitation of liability of Erich Schlemper GmbH
Erich Schlemper GmbH shall only be liable to users for damages resulting from willful or grossly negligent breaches of contract and for damages resulting from slightly negligent breaches of material contractual obligations. In the latter case, liability is limited to the damage typically foreseeable at the time the contract was concluded. The liability of Erich Schlemper GmbH for damages to life, body and health as well as according to the Product Liability Act shall remain unaffected by this provision. The above limitations of liability shall also apply to breaches of duty by the legal representatives or vicarious agents of Erich Schlemper GmbH.
The Community competition is subject to the data protection provisions, which are hereby acknowledged.
a) There are no ancillary agreements. Amendments and supplements to these TERMS OF USE, including this clause, must be made in writing. This formal requirement can only be waived by written agreement. E-mails, text messages, telefaxes or computer faxes do not satisfy the written form requirement.
b) These TERMS OF USE and the legal relationship between Erich Schlemper GmbH and the user shall be governed by German law.
c) Place of fulfillment and place of jurisdiction is, as far as legally permissible, the registered office of Erich Schlemper GmbH.
d) Should individual provisions of these TERMS OF USE be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The contracting parties undertake to replace an invalid provision with a valid provision that comes as close as possible to the economic intent and purpose of the invalid provision. This applies accordingly in the event of contractual loopholes.
